PowerhubSA: Terms and Conditions 

These Terms and Conditions apply to all goods and services supplied, or to be supplied, by PowerhubSA to the Customer or to any third party acting on the Customer’s behalf. References to the Customer include the Customer’s successors and permitted assigns. Where the Customer comprises more than one person or entity, each Customer is jointly and severally bound by these Terms and Conditions. 

 

  1. Acceptance

1.1 Any instruction, order, request or acceptance by the Customer for the supply of goods or services by PowerhubSA constitutes acceptance of these Terms and Conditions. 

1.2 Where more than one Customer enters into this agreement, each Customer is jointly and severally liable for all obligations, including payment of all amounts owing to PowerhubSA. 

1.3 Once accepted, these Terms and Conditions are binding and may only be amended, varied or terminated with the written agreement of PowerhubSA or otherwise in accordance with these Terms. 

1.4 No employee, agent or representative of PowerhubSA has authority to make any representation, warranty or agreement that is inconsistent with these Terms unless expressly authorised in writing by a director or authorised manager of PowerhubSA. 

1.5 Acceptance may occur by signed quotation, email, SMS or payment of a deposit 

 

  1. Goods

The goods supplied are those described in the relevant quotation, estimate, invoice, work authorisation, work order or any other documentation issued by PowerhubSA. 

 

  1. 3.Quotations

3.1 The price payable for goods and services is the amount specified in the quotation provided by PowerhubSA. 

3.2 Quotations remain valid only for the period specified in the quotation unless withdrawn earlier by PowerhubSA. PowerhubSA reserve the right to withdraw any quotation, estimate or offer at any time.  

3.3 By accepting a quotation, the Customer agrees to: 

  1. the terms of the quotation; 
  1. these Terms and Conditions; and 
  1. the applicable payment terms, including payment upon completion of the works unless otherwise agreed in writing. 

 

 

  1. Price and Payment

4.1 The price payable shall be, at PowerhubSA’s discretion: 

  1. the amount specified in the invoice for goods and/or services supplied; or 
  1. the quoted or estimated price accepted by the Customer in writing within the validity period stated in the quotation. 

4.2 A 20% Deposit expected before works will proceed by PowerhubSA 

4.2 Any variation to the agreed scope of works, plans, specifications or materials requested by the Customer, or made necessary by site conditions or other unforeseen circumstances, will constitute a variation and will be charged at PowerhubSA’s applicable rates or in accordance with an approved quotation. Variations will be itemised on the invoice and may include 

  1. Switchboard upgrades 
  1. Upgrades to mains power 
  1. Asbestos Removal 
  1. Structural works 
  1. Plastering  
  1. Carpentry 
  1. Unplanned Crane Hire or Additional lifting equipment (Scissor or Boom) 
  1. Engineering  
  1. Council approvals 

4.3 The price offered assumes the existing electrical supply is adequately sized to meet the demands of the current and newly connected equipment 

4.4 Payment for all approved variations are due upon completion of the relevant works unless otherwise agreed in writing. 

4.5 PowerhubSA may, at its sole discretion, approve extended payment terms for selected customers. 

4.7 Payments may be made by cash, cheque, electronic funds transfer or credit card. A credit card surcharge of up to 2% may apply. 

 

  1. Overdue Payments

5.1 If any amount owing to PowerhubSA remains unpaid after the due date, PowerhubSA may suspend or cancel any outstanding orders or services without prejudice to any other rights or remedies available at law. 

5.2 Where an account remains unpaid beyond the agreed payment terms, PowerhubSA may issue a formal notice of demand and commence debt recovery proceedings. 

5.3 Where an account remains unpaid beyond the agreed payment terms, PowerhubSA may also suspend any warranty support and/or refuse commissioning of any additional works. 

5.3 PowerhubSA reserves the right to charge interest on overdue amounts at the applicable rate prescribed under the Taxation Administration Act 1996 (SA), currently 10.69% per annum or such other rate as may apply from time to time. 

5.4 The Customer is liable for all reasonable costs incurred by PowerhubSA in recovering overdue amounts, including legal and debt collection costs. 

5.5 Where payment remains outstanding after written notice and all lawful requirements have been satisfied, PowerHubSA reserves the right to enter the property at a reasonable time (where legally permitted) to disconnect and/or remove equipment supplied by PowerHubSA. Any costs associated with removal, reinstatement, transport, storage and reinstallation are payable by the customer. 

 5.6 Removal of equipment does not extinguish the customer’s obligation to pay any outstanding balance or recovery costs. 

 

  1. Warranty

6.1 Goods not manufactured by PowerhubSA are supplied subject only to the manufacturer’s warranty. 

6.2 To the extent permitted by law, PowerhubSA provides no additional warranty in relation to such goods and accepts no liability beyond the manufacturer’s offered warranty. 

6.3 PowerhubSA provide an installation workmanship warranty for 10 years when the equipment is used in a residential house under normal residential use. 10 years begins on the day of first connection to AC power. A start delay to this period can only be made with written approval from PowerhubSA 

6.3 Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law. 

 

  1. Force Majeure

PowerhubSA is not liable for any delay or failure to perform its obligations where such delay or failure results from circumstances beyond its reasonable control, including but not limited to natural disasters, industrial disputes, supply shortages, acts of government, utility failures or other force majeure events. 

 

  1. Promotions

8.1 Promotional offers are available only for the period specified and are subject to any conditions stated in the relevant quotation or advertisement. 

8.2 Unless expressly stated otherwise, promotional offers cannot be used in conjunction with any other discount, special offer or promotion. 

  1. Site Conditions

9.1 Pricing assumes safe roof access, adequate ceiling space, suitable structural framing and unrestricted access. Additional costs may apply where unforeseen site conditions are encountered 

 

  1. 10. Contract Works

10.1 All quotations are based solely upon the drawings, specifications and information provided to PowerhubSA at the time of quoting. 

10.2 PowerhubSA assumes that all plans, specifications and documentation supplied are accurate, complete and include: 

(a) the location and routing of all existing and proposed services; 

(b) all selected fixtures, fittings and materials; and 

(c) all information necessary to accurately price and complete the works. 

10.3 Unless expressly included in the quotation, PowerhubSA has not allowed for work arising from: 

  1. incomplete or inaccurate documentation 
  1. discrepancies between plans and site conditions 
  1. undocumented services 
  1. clashes with existing infrastructure 
  1. design changes 
  1. additional work requested after the quotation has been accepted 

10.4 Any such work will constitute a variation and will only proceed after written approval has been obtained from the Customer. 

10.5 PowerhubSA is not liable for any delay, additional costs, financial loss or legal consequences arising from inaccuracies, omissions or discrepancies in plans, specifications or information supplied by the Customer or its consultants. 

  1. Roof and Ceiling Disclaimer

Every care is taken when working on roofs and ceilings. PowerHub SA is not responsible for damage resulting from pre-existing deterioration, brittle plaster or fragile roof materials such as lathe & plaster ceilings. 

  1. Commissioning &WiFi

Commissioning and basic operational demonstration are included. Connection to customer Wi-Fi or third-party smart home platforms is excluded unless specified. WiFi connection is generally via Passwords which our installation team are not permitted to know.  

  1. 13. Customer Acknowledgement and Disclaimer

13.1 The Customer acknowledges that it has relied on its own enquiries, judgement and skill in entering into this agreement. 

13.2 Except as expressly provided in these Terms, or as required under the Australian Consumer Law, PowerhubSA makes no representation or warranty regarding the goods or services supplied. 

13.3 To the fullest extent permitted by law, the Customer releases PowerhubSA from any claim arising from any representation or statement made by any employee or representative of PowerhubSA that is not expressly contained in these Terms or otherwise confirmed in writing by an authorised representative of PowerhubSA. 

13.4 Nothing in these Terms excludes, restricts or modifies any consumer guarantees, statutory rights or remedies that cannot lawfully be excluded under Australian Consumer Law or any other applicable legislation.
